These terms are an agreement between you and Original Labs, a company registered in Azerbaijan ("we", "us"), about your use of the kultivo app for iOS and Android and the kultivo website (together, "kultivo"). By installing or using kultivo you accept these terms. If you do not accept them, please do not use it. If you are under 18, read these terms with a parent or guardian, who accepts them on your behalf.
What kultivo is
kultivo is a study aid for Azerbaijani school and entrance-exam courses. It offers lessons, narrated audio, practice questions, review, mock exams and an AI tutor that explains questions. Everything except the AI tutor works without an internet connection. kultivo is currently free to use.
Your licence
We give you a personal, non-exclusive, non-transferable and revocable licence to install kultivo on devices you own or control and to use it for your own study. You may not:
- copy, sell, rent, publish or redistribute kultivo or its content, in whole or in part;
- extract the lessons, questions, answers, audio or figures from the app, by hand at scale or by automated means;
- decompile, reverse engineer or modify the app, except where the law allows it regardless of this restriction;
- use kultivo for any unlawful purpose.
Content and ownership
kultivo, its design, software, lessons, explanations, audio and figures belong to Original Labs or to the people who have licensed them to us. Some material is based on published textbooks and exam papers; the rights in that material remain with their owners. Names of exams, institutions and publishers are used only to describe which course a lesson belongs to.
kultivo is an independent product. It is not an official publication of, or endorsed by, the State Examination Centre (DİM), the Ministry of Science and Education of the Republic of Azerbaijan, or any textbook publisher.
Accuracy and results
We work hard to keep lessons, answers and explanations correct, but kultivo may contain mistakes. It supports your study; it does not replace your teacher, your textbook or official exam materials. Mock exams and scores are practice estimates and do not predict or guarantee any result in a real exam. If you find a mistake, please tell us.
The AI tutor
The "Ask AI" tutor writes its replies with an artificial intelligence model. Its replies are generated automatically, can be wrong or incomplete, and are not checked by a person before you see them. Check what it says against the lesson, the book's answer or your teacher before relying on it.
When you use the tutor you agree not to:
- write anything unlawful, abusive or hateful, or anything unrelated to studying;
- include other people's personal information, or your own beyond what a question needs;
- send requests automatically, try to get around the limits on how often you can ask, or use the tutor as a general-purpose AI service;
- try to make the tutor produce harmful content.
The tutor depends on outside services and may be slowed, limited or switched off at any time, for everyone or for one install, without notice. How your questions are handled is described in our Privacy Policy.
Your data
Your progress, notes and conversations are stored on your device, not with us. You are responsible for keeping your device and its backups. We cannot restore data that is deleted or lost along with a device.
Changes and availability
We may change, add or remove features and content, and update the app, at any time. We may stop offering kultivo, in whole or in part. Where it is reasonable, we will give notice of significant changes in the app or on the website.
Disclaimer
kultivo is provided "as is" and "as available". To the fullest extent the law allows, we make no promises, express or implied, that it will be error-free, uninterrupted or fit for a particular purpose, beyond those that cannot be excluded by law.
Limitation of liability
To the fullest extent the law allows, Original Labs is not liable for any indirect or consequential loss, for lost data, or for exam results, arising from your use of kultivo or your inability to use it. Nothing in these terms limits liability that cannot be limited under the law of the Republic of Azerbaijan or your consumer rights.
Ending these terms
You can stop using kultivo at any time by deleting the app. We may end your licence if you break these terms. The sections on content and ownership, disclaimer, limitation of liability and governing law continue after the terms end.
App Store and Google Play
If you got kultivo from Apple's App Store, these terms are between you and Original Labs, not Apple. Apple is not responsible for kultivo or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability, legal compliance or intellectual-property claims; we are, to the extent these terms say so. If kultivo fails to conform to any applicable warranty, you may notify Apple, and Apple's sole obligation will be to refund the purchase price, if any. You confirm that you are not located in a country subject to a United States government embargo and are not on any United States government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use must also follow the App Store's Usage Rules.
If you got kultivo from Google Play, your use must also follow the Google Play Terms of Service.
Governing law
These terms are governed by the law of the Republic of Azerbaijan. Any dispute that cannot be settled by talking to us first will be decided by the competent courts of the Republic of Azerbaijan, unless the law of the country where you live gives you the right to bring it there.
Changes to these terms
We may update these terms. The effective date at the top shows when they last changed. If you keep using kultivo after a change takes effect, you accept the new terms.
